Default Polygany?

I know that there was a movement to end polygamy as early as 1956, so I assume it is pretty much the accepted form of marriage these days, at least in public. Are there those who still practice ploygamy, the way there are still Mormons practicing polygamy here? What are the penalties for being found to have more than one wife?

It was not just a movement. The reforms headed by the late President Habib Bourgiba included an end to polygamy, the right for everyone to go to school and much more. It is illegal to have more than one wife - or husband, for that matter!

It is illegal here as well but became impossible to enforce unless the one of the wives is under the age of consent. There are groups who still practice it here, even though it is against the law.

What are the penalties for people found having more than one spouse in Tunisia? Does the law focus on the number of spouses registered with the government or does it focus on the number of "non-blood-related" adults living in the same home?

I do not know what the punishment would be, but considering the amount of paperwork you have to go through to marry in Tunisia, and that no marriages are recognised unless performed by a state official, I wouldn't think that this wold be a problem. Tunisia is a small country so you are never really out of reach. Living together without being married is just not done in a Muslim country and since it is so long since polygamy was outlawed people would certainly notice if there were too many wives somewhere.

Speaking from an Islamic point a view, polygamy is permitted but just because your allowed doesnt mean obligatory. That being said, most Tunisian women do not like the idea. However some woman who have no desire anymore give permission to their husbands and marriage can be done without state recognition, an imam and two witnesses. If he ever gets caught he just has to say I am cheating on my wife with a girlfriend. That is permissable and not punishable by law. Also note that polygamy is not practiced as many adults in one house. If a man has many wives he must treat them equal, meaning many houses

Tunisia and Turkey are the only muslim country where its not allowed

There are hundreds of men in Tunisia who marry a woman just with an ORFI. Unfortunately, many women agree to such marriage which allows you to live together but with no other obligations. It is very popular in Egypt, but happens quite often in Tunisia too. It is not officially allowed, nevertheless people do it,and some men do marry a number of women at the same time with only this paper called ORFI.

Have only heard of this in Egypt - never in Tunisia.

It is a kind of informal marriage called an orfi marriage, in which the couple—because they want to get married but don’t have the money, or perhaps because they just want to sleep together—sign a contract saying they are married… but apparently when such marriages dissolve, children of the union are frequently not acknowledged by the fathers.

Is it not done more so that people may co-habitate in Egpyt?
