Default after settlement visa

just wondering if anybody has gone through the process of applying for the infident leave to remain- i think thats what its called??

can your hubby or wife only apply 28 days before the settlement visa is up? i know the kind of evidence and everything to send with the application, just wondering if it's possible to apply before the 2 years

also if they go back home to tunisia for a long period of time during the 2 years of the settlement visa oes this stop them from being able to apply for leave to remain?
therefore do they have to remain in the for the full 2 years to apply? or can they apply for this once back in tunisia?i know obviously this effects what supporting documents you can send with the application.

just trying to work a few things out and whether moving to tunisia before the settlement expires means not being able to apply for the next

Hi,
just been looking on that site, do they have to take a life in the uk test before their indefinate leave to remain will be granted?
because many of the questions i would not know myself lol

Hi Gina, I think they do have to take this test now before indefinite leave. And I also wouldnt have a clue about half the qustions you get on it. My dad printed one off (dont know if it was for this or citizenship) and it was historical questions too. Think we're gonna be spendin the next year swotting

Hi all,

My understanding is that indefinite leave to remain is granted subject to the person passing the ridiculous 'Life in the UK' test (there's a book you need to buy - more money for the government!! - outlining what the person needs to know) or undertaking an ESOL/citizenship course which local FE colleges often offer (but you have to pay). Also, you can't apply more than 28 days before the settlement visa is due to expire - they need the applicant to have lived with the partner in the UK for the whole 2 years (give or take short breaks away) as evidence that the relationship has been sustained and that you intend to remain together. Large periods of absence for the UK may be problematic I would imagine because the 2 year settlement period is effectively a 'probationary' period in preparation for ILR. You nevre know, everything changes year by year, and what applies now maybe entirely different in a year's time (and I'll eat my hat if the already extortionate fees don't rise again!!!).

when i contacted immigration about the possiblity of moving to france and how this would effect applying for the leave to remain they advised me if that when applying if you havent met the crtieria for the probabtion period then an extension would be granted so that you can complete and apply.

if do wither have to pass the test which is probably one of the hardest things to do or sit the course, if you thought that getting the first visa for them to come had a lot of papr work this has more, i forgot exactly how much but you have to show from ifferent sources to proove that you've been living together for this time, so m best advice ladies is getting your hubbys name on your bills so you can start gathering your evidence!!!

I am sure things have changed since me and my now ex applied for ILR but then there was no "Life in th UK" test that was only for couples that were both non English speaking. We had bills etc transferred into joint names im sure you know all the do***ents needed. Good luck anyway.
