Exclamation EEA FAMILY PERMIT -Need Advice-

My girlfriend is Irish ( from Republic of Ireland ) i met her since nearly two years and it was by chance Over Internet. Ower Relation Began after 6 month from our First contact (over internet) Then we did fall in love with each other. She have 3 sons and she live in england since 1988. I have a so nice relation with her 3 sons we meet every day over internet we play we talk and we laught a lot i truthly i feel so close to them and even her younger son he told me that he loves me and i am so happy for this. Well she did send me an invitation in December 2006 for 2 weeks holiday for christmas and of course i got refused coz (and with stupid thing ididnt bring the 3 months payslips) ( bad undertanding of what they need for the application). Then ididnt wanted to apply again again coz i did heared that they wont gives a visitors visa. then my girlfriend she did try hard ( coz her responsability of childrens) and she did visit me twice the first was in may for two weeks and the second was in October and for two weeks as well. Then we (and after her sons OK) we did decide to get married and it will be in the next Juin. We did search alot and we did read alot over internet about the requirements to have a success visa but we did find out about the EEA Family permit and we did find That it will be a bit Relaxed than a Marriage Visa so my questions is :

1/ Did i have the right for a EEA family Permit ?
2/ What is the best way in my case a EEA fmily permit or a Spouse Visa ?
3/ Is my Visitor Visa Reuse will Inflict in my future application ? (when idid apply for a visitor visa idid explain to them my relationship with my girlfriend)
4/ My relationship with her sons can it Help ? If yes How ?
5/ Do ishould save even my conversations over MSN with her and with her boys for Proof of accomodation ? If yes it will help abit ?
6/ Do a EEA family Permit ?


And finaly Thanks for everybody will help and even for who wont help. Thanks

i think she need to instruct a lawyer from the uk which are free they are called immigration advisery service itīs a charity and she will get the best advice of what to do because i read what you wrote and it seems you missunderstood some of the rules or the immigration law,the truth of the matter donīt think that matters will be as easy as you expect they will try to put put you through hell,for them to see if the relationship is genuine,if you get married and you apply it might take you up to two years of waiting with few refusals

My friends have had very different experiences when it comes to visa applications, but I don't know where you got it from that it will take up to 2 years, Issam? Many have been given visa on first attempt, some have re-applied and only a couple of people that I know have had to wait for several years. As always, this varies with each case. It is of course very important to be well prepared and bring everything they ask for and preferrably a bit more when going to an interview. I do agree with Issam that your girlfriend should seek legal advise to give you the best possible chance of getting to be together.

i think there is big reshuffle in the immigration issus right now,i donīt know if you following the news,this guy applied for a tourist visa and got refused,if things were going to be ok he should got it with no problems,i donīt know when your freinds applied because if you go to the home office website you will see how many laws has changed,me personelly i had to wait five years and half in the uk to get an answer and thatīs after taking a laywer to court, and i exposed him in the bbc1 radio station last year in the programme face the facthe was ripping peaple of taking them to the cleaners and iīve been backed up by the daily record to scrap him of the registery of lawyers

Sorry to hear you have had bad experiences, but that still does not explain how you came up with the period of 2 years, which is all I was asking about. The examples you give are, like mine, of individual cases and have nothing to do with Nizar, especially if they applied for totally different visas. My friends applied at the British Embassy in Tunisia, over a number of years, and have as I stated also they have had various results. Yes, I am of course aware that laws change but that does not mean you can tell a person that he will be abused for a certain amount of time before getting a final result. He and his girlfriend might indeed be given grief, but if they do prepare well and are aware that they might not get what they wish for straight away, waiting might be easier.

one of my employers in one of the compagnies that i own in the uk is tunisian national he was telling me his story that he got married to the women he loves and they had kid,he has been refused 3 times had to wait 2 years to get granted,they put them through very hard time for no reasons,some times they try to pressurise the relationship to see if it genuine relationship,this is one of the cases,i keep in touch with a lot who live in london,in the midlands and up northen the borders,so as far as i know it depends how they look at your case

Yes indeed they can treat people very differently, as I mentioned before from my several examples (from all over Britain) it appears that some get visas quickly and some have to wait, and you can not really tell how long it will take. Indeed it seems to differ a lot without there always seeming to be a clear reason and many I know feel the decision can be influenced by personal feelings. At least, in the U.K. you do have the free legal aid that you referred to, which we don't here. But, we only had to wait 5,5 months and are not complaining.

iīve been living in europe for sevreal years,czech republic,poland,germany,monaco,france,italy,austri a,denmark before i dicided to go to the uk,iīm still on my tunisian nationality although iīve been offered the czech nationality,it seemed to me only with the uk that things got messed up with my residence,which i had to take the home office to court and appeal against a decision which it shoud not be for my case and i won my case to get my work permit and thanks to all the peaple who backed up my case specially the ones who work in the discovery channel

you should apply under EEA familly reunion because your wife or your future wife is from the republic of irland settled in the united kingdom which make it easier to get your case proccessed quikly,i think if you get positive decision youīll get granted 5 years and then you will be entitled for indifinite leave to remain and thaīs after sitting for a test live in the uk,let me know nizar if there is any new updates,iīm helping at the moment some one who got a case similair to yours,good luck
